Estate Planning Basics


Trust

A trust is a fiduciary arrangement that allows a trustee to manage your assets on behalf of your beneficiaries. You can customize and design your trust to specify exactly how and when your assets pass to your beneficiaries. A properly designed trust can also take advantage of estate tax exemptions to minimize taxes, keep your estate out of probate, and protect your heirs’ inheritance.


power of attorney

A Financial Power of Attorney (POA) enables your loved ones to manage your finances in the event of your incapacity. Without a valid POA, your agents will have to go through a lengthy court process called Conservatorship to obtain the ability to manage your financial affairs. You can define what powers your agent can possess and ensure your wishes are followed when you are unable to direct your finances yourself.


Will

A will allows you to determine who will get your assets and decide who will be the guardian of your children, in the event they are minors at your death. A will also allows you to select a person to represent you after your death, called an executor. This person can present your choices to the court through the probate process, to ensure your desires are expressed.
 


probate

Probate is the process by which the Court decides how a deceased person's assets are distributed to their heirs and all debts owed to creditors are paid off. The probate process can be lengthy, expensive, and part of the public record. We can help your executor navigate this daunting process and protect your assets and beneficiaries.


Advance health Care directive

In the case of incapacity, honoring your wishes is of the utmost importance.  An advance healthcare directive (AHD) will allow your loved ones to manage your care in accordance with your wishes in the event that you become incapacitated. The AHD can include a living will, a medical power of attorney for healthcare decisions, and HIPAA waivers. These documents will allow your agents access to medical information and also direct physicians how to proceed when you are not able to direct your care on your own. The AHD can be specific or general, depending on the desire of each client.


trust administration

Administering a trust after the death of a loved one may seem to be an overwhelming task for some trustees. We can help your trustee manage the trust assets and property in accordance with your estate plan. Should questions arise, Cannavino Law can facilitate the process so your trustee receives the necessary guidance and your beneficiaries’ assets are secure.
